How Does A Bond Work?

After the defendant is arrested, there is a local bond hearing where the bail and bond amounts are set by the judge.  This is the amount required to secure the release of the defendant from custody until the court proceedings start. Many times, court dates and trials are set for weeks or even months down the road.  Without the option of posting bail or paying a bond, the defendant would have to stay in jail until their court date. Being in jail for weeks or months waiting for a trial could have many negative effects on someone’s life, especially if they are innocent.  Bail and bond money acts as a sort of insurance to signal to the judge and authorities that you will appear for your assigned court date. 
  

A family member, a close friend, or sometimes even the defendant will make initial contact with a bail bondsman to start the process of posting the bail bond on behalf of the defendant. Once the bail bond has been issued, the person that is paying and initiating the bond, known as the indemnitor or co-signer, will be required to complete all the relevant paperwork and pay the premium, which is calculated as a percentage of the total bond amount. By signing the bonding paperwork, the indemnitor is guaranteeing that they will pay the full bond amount if the defendant fails to appear in court on the scheduled date.

A judge will typically set the bail amount, while taking into account the county judicial schedule, and various details of the case. When a percentage of the bond is paid, the bail agent often requires some form of collateral to secure the bond and ensure the defendant’s appearance in court. Collateral can be anything of value that is offered to secure the bond, such as cash, property deeds, business assets, jewelry, etc. Upon complete closure of the defendant’s case and payment of all bonds in full, the collateral is then returned to the person that guaranteed the bond.

Bail is the tool that the courts use to make sure that defendant arrives at court for their proceedings when they are supposed to. At the first arrest, bail is set by the judge depending on what crime the defendant has been charged with, and whether the judge considers the defendant to be a “flight risk”.

A defendant is not considered a flight risk if he or she has a respected presence in their community, has a steady job, or has other family members in the same community.  When bail is paid, there are times when families or friends cannot afford to pay. That is when they will call a licensed bail bondsman who will require some sort of collateral to ensure that the defendant will keep up their part of the court proceedings and any other legal requirements. The bondsman and the guarantor will then pledge to the court that the defendant will perform all of his or her proper duties in the eyes of the court.

When it comes to judicial proceedings, if the defendant successfully fulfills all of their responsibilities, the defendant or the guarantor will only need to pay the bondsman for his fee that was paid before the scheduled court date, and will not be liable for the entire bail amount.  However, if the defendant skips bail, meaning they don’t show up for their court date, the indemnitor will be required to pay the full bail amount. The defendant will typically do everything that is required of them so that the indemnitor will not have to pay the entire bail amount.
